Chicken of the Sea complies with the United States Dolphin Protection Consumer Information Act (“DPCIA”), 16 U.S.C. §§ 1385 et seq., and the DPCIA’s implementing regulations, 50 C.F.R. §§ 216.92 et seq., that the United States Department of Commerce, National Oceanic and Atmospheric Administration (“NOAA”), administers and enforces. The DPCIA and its corresponding regulations require, among other things, the captains of the fishing vessels from which Chicken of the Sea obtains tuna to certify that no net or other fishing gear was intentionally deployed on or used to encircle dolphins during the fishing trip, and that no dolphins were killed or seriously injured by any fishing gear in which the tuna were caught. The “Dolphin Safe” logo on Chicken of the Sea packaging indicates that tuna Chicken of the Sea sells was caught in compliance with the DPCIA and its implementing regulations.
